The CPF is not part of the estate. Unlike a life insurance policy or a savings plan, the rights recorded in the personal training account do not constitute a transferable claim. Their legal nature, linked to the individual holder via their social security number, excludes any hereditary transfer.
CPF Contributions and Recovery by France Compétences upon Death
The question of the fate of contributions deserves special attention, as it introduces a nuance that most analyses overlook. CPF rights consist of two distinct layers: the rights acquired annually by the employee and the contributions paid by third parties (employer, professional branch, region, Pôle emploi now France Travail).
France Compétences would have a mechanism allowing it to recover unused contributions in the event of the holder’s death or retirement. This logic is justified: the contribution is not an acquired right in the same way as the annual funding. It results from targeted financing, often conditioned on a specific training project.
In practice, we observe that this distinction is largely ignored by the heirs who attempt to recover the CPF balance of a deceased relative. The refusal they encounter concerns both the individual rights and the contributions, but for different legal reasons. Understanding what happens to the CPF after a death requires distinguishing these two components.
Ongoing CPF Training at the Time of Death: What Operational Treatment
The most complex scenario arises when the holder dies while a training course is already underway. Several configurations coexist, and no unified procedure has been published by the Caisse des Dépôts to address them.

File Approved, Training Not Started
When the file has been accepted on Mon Compte Formation but the session has not started, the Caisse des Dépôts proceeds with the cancellation upon receipt of the death certificate. No disbursement occurs to the training organization. The reserved rights reintegrate the overall balance before the final closure of the account.
Partially Attended Training
The case of ongoing training raises the question of prorated payment. The training organization has engaged pedagogical resources. The Caisse des Dépôts, as the technical operator, manages the payment according to the general terms of use of the platform. We recommend that heirs promptly report the death to prevent an automatic full payment from being triggered.
Pending Refund
If the holder was entitled to a refund (training canceled by the organization, overpayment), this refund does not go to the heirs. The CPF balance is never converted into cash for the benefit of the estate.
Closure of the CPF Account after Death: Role of the Caisse des Dépôts
The Caisse des Dépôts et Consignations manages the administrative and financial aspects of the CPF. Upon receipt of the death notification, transmitted by the civil registry services, the account is deactivated. Heirs do not have to carry out the closure process themselves, unlike other accounts (banking, tax).
The closure leads to several simultaneous consequences:
- Removal of access to the account on Mon Compte Formation, with no retrospective consultation possible by the heirs
- Cancellation of any training files in progress, including those awaiting validation by the organization
- Permanent extinction of acquired rights, which are neither returned to the heirs nor to a mutual fund accessible to relatives
The notary in charge of the estate has no authority over the CPF. This point regularly generates misunderstandings: families contact the notary’s office thinking that the CPF balance is included in the estate inventory. The CPF is a personal right, not a property asset.
CPF Rights and Transfer between Living Persons: Why the Estate Has No Legal Basis
Article L6323-1 of the Labor Code links the CPF to the active individual. This personal link not only prohibits inheritance transfer but also any transfer between living persons. Neither assignment, donation, nor sharing between spouses is possible.
This legal framework has a direct consequence on estate planning: the CPF cannot be optimized in a transmission logic. Unlike a life insurance contract where the beneficiary clause directs funds outside the estate, the CPF has no equivalent mechanism.

Some employees accumulate a significant balance without ever utilizing their rights. Regular use of the CPF remains the only strategy to avoid losing these rights, as no mechanism for carryover, conversion, or transmission exists under French law.
Employment Contract, Employer, and CPF of the Deceased Employee
The death of the employee terminates the employment contract. The employer pays the amounts due to the heirs (salary, compensatory paid leave, redeemable employee savings). The CPF does not fall within this scope.
If the employer had paid a CPF contribution to fund a specific training, this contribution follows the regime described above: it may be recovered by France Compétences rather than returned to the family. The employer also cannot redirect the contribution to another employee.
Collective agreements and company agreements that provide for CPF contributions generally contain no clause regarding the death of the beneficiary. We recommend that HR managers check this point during the negotiation of such agreements, if only to properly inform families when the time comes.
The CPF balance of a deceased employee disappears without a trace in the family estate. This reality, however abrupt it may be, stems from a legislative choice consistent with the nature of the system: to finance the upskilling of an active individual, not to create a transferable savings. The only rational response remains to utilize one’s CPF rights during their lifetime, allocating them to training whose value is concretely reflected in the professional journey.
